trustSYSTEM Business Terms of Service

trustSYSTEM is a QWYK iSoft product operated by IWYNO FINWORKS LLC dba QWYK iSoft ("QWYK iSoft," "we," "us," or "our"). These Business Terms apply when you create, claim, manage, administer, or use a business profile, dashboard, review campaign, integration, widget, report, subscription, or related business feature through trustSYSTEM at https://trust.iqwyk.com.

These terms are written for business owners, managers, staff, agencies, contractors, and other authorized representatives who use trustSYSTEM for a business. Customers and other people who submit reviews, testimonials, photos, audio, video, ratings, or other feedback are also covered by the separate trustSYSTEM Reviewer Terms.

These terms supplement the QWYK iSoft Terms of Service, the trustSYSTEM Reviewer Terms, the trustSYSTEM Acceptable Use Policy, and the trustSYSTEM Privacy Policy. If there is a conflict, these Business Terms control for business use of trustSYSTEM.

1. What trustSYSTEM Does

trustSYSTEM helps businesses create and manage public-facing business profiles, collect and display customer feedback, manage review-related content, and, where enabled, connect third-party services such as YouTube for customer video review publishing.

trustSYSTEM is a platform tool. We do not operate your business, verify every review before it appears, guarantee any rating, guarantee customer outcomes, or promise that a profile, review, video, score, or listing will increase sales, reputation, search visibility, revenue, or customer trust.

2. Business Profiles and Authority

You may create, claim, or manage a trustSYSTEM business profile only if you are the owner of the business or are authorized to act for that business.

You are responsible for:

Making sure profile information is accurate, current, lawful, and not misleading.
Keeping licenses, certifications, operating details, prices, availability, locations, and disclaimers up to date.
Ensuring that anyone you add as an owner, manager, employee, contractor, or agent is authorized and follows these terms.
Removing access for anyone who should no longer manage the profile.

We may request verification of your authority, suspend access, merge duplicate profiles, reject ownership claims, remove misleading information, or limit profile features when we believe it is necessary to protect reviewers, users, businesses, or the platform.

3. Reviews, Ratings, and Customer Content

Reviews and ratings should reflect genuine first-hand customer experiences. You may ask customers to leave reviews, but you may not buy fake reviews, pressure customers to remove negative reviews, post reviews for your own business unless clearly disclosed, or ask employees, contractors, friends, or vendors to hide their relationship with you.

When a customer submits a review, rating, testimonial, photo, audio recording, video, written comment, or other feedback through trustSYSTEM, that customer is granting permission both to QWYK iSoft and to the business profile owner or authorized business representative receiving the feedback. This permission allows QWYK iSoft to operate trustSYSTEM and allows the business to view, respond to, display, publish, share, use, and preserve the submitted feedback for review, reputation, customer service, marketing, dispute, compliance, and business-record purposes, subject to applicable law, platform settings, and any limits clearly presented at the time of submission.

Businesses are responsible for making review requests clear and lawful. If you ask a customer for feedback, you must not hide that the feedback may be shared with you as the business being reviewed and may be displayed or used as permitted by trustSYSTEM, the Reviewer Terms, and the customer's submission choices.

We may moderate, remove, hide, label, refuse to publish, or limit content that appears fake, abusive, unlawful, private, misleading, spammy, incentivized without disclosure, unrelated to the business, or otherwise inconsistent with our Acceptable Use Policy.

We are not responsible for customer opinions, ratings, reviews, media, or other user-generated content. We do not guarantee that reviews will be positive, accurate, complete, available, displayed in a particular order, or displayed forever.

4. Your Content and License

You keep ownership of business profile information, photos, videos, logos, responses, and other content you submit, subject to any rights held by others.

You grant QWYK iSoft a worldwide, non-exclusive, royalty-free license to host, copy, display, publish, adapt, transmit, and use your content as needed to operate, protect, promote, and improve trustSYSTEM and related QWYK iSoft services. This license includes use in search results, profile pages, review pages, embeds, widgets, notifications, reports, and service previews.

Reviewer-submitted content is covered by the trustSYSTEM Reviewer Terms. You may use reviewer content only as permitted by those terms, the submission flow, the reviewer's choices, applicable law, and trustSYSTEM settings.

You represent that you have the rights needed to provide your business content and that your content does not violate any law, third-party right, confidentiality obligation, platform policy, or advertising rule.

5. YouTube and Third-Party Integrations

If you connect a Google or YouTube account, you authorize trustSYSTEM to use the approved connection only for the features you enable, such as verifying your channel and uploading approved customer video reviews. The trustSYSTEM Privacy Policy explains the Google user data we access, how we use it, and how deletion works.

Third-party services, including Google, YouTube, hosting providers, payment processors, analytics providers, or messaging providers, are governed by their own terms and privacy policies. We are not responsible for their availability, decisions, account actions, content rules, delays, removals, or data practices.

6. Acceptable Use and Compliance

You must use trustSYSTEM lawfully and responsibly. You may not:

Misrepresent your business, authority, identity, ownership, review source, customer relationship, or service quality.
Upload illegal, infringing, defamatory, abusive, explicit, dangerous, deceptive, private, or confidential content.
Use trustSYSTEM for harassment, retaliation, threats, discrimination, spam, scraping, phishing, malware, credential abuse, or platform manipulation.
Interfere with trustSYSTEM security, availability, ranking, moderation, review collection, or publishing systems.
Use trustSYSTEM in a way that violates consumer protection, advertising, privacy, marketing, professional licensing, or platform rules that apply to your business.

You are responsible for your own legal compliance, including required licenses, consent to collect, record, receive, use, publish, or share customer feedback, consent to record or publish video or audio, review solicitation rules, privacy notices, marketing consent, industry-specific disclaimers, and any obligations to customers, reviewers, workers, regulators, or third-party platforms.

7. Suspension, Termination, and Appeals

We may suspend, limit, remove, or terminate a profile, account, integration, review, video, response, widget, or other feature if we believe there is a legal, safety, security, integrity, reputational, operational, or policy risk.

Where practical, we may provide notice or an opportunity to appeal, but we may act immediately when needed to protect users, businesses, third-party services, or QWYK iSoft.

If your account is terminated, you must stop using trustSYSTEM. Sections that by nature should survive, including ownership, content license, confidentiality, payment obligations, disclaimers, liability limits, indemnity, and dispute terms, will continue to apply.

8. Fees and Paid Features

Some trustSYSTEM features may require payment or a subscription. Prices, plan limits, billing periods, cancellation rules, and renewal terms will be shown in the applicable checkout, order, statement of work, or plan page. If a payment is routed through EZ Pay Tekk, the EZ Pay Tekk Terms of Service, Privacy Policy, Acceptable Use Policy, and Refund and Dispute Policy are incorporated by reference for that payment workflow. Fees are non-refundable except where required by law or expressly stated in writing.

You are responsible for taxes, chargebacks, failed payments, and keeping billing information current.

9. No Warranties

trustSYSTEM is provided "as is" and "as available." We do not promise uninterrupted service, error-free operation, specific rankings, specific review volume, specific customer behavior, business results, or compatibility with every browser, device, system, third-party service, or business process.

10. Liability and Indemnity

To the fullest extent permitted by law, QWYK iSoft is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of goodwill, data, reputation, customers, or revenue.

Our total liability for trustSYSTEM-related claims will not exceed the amount you paid us for trustSYSTEM in the 12 months before the event giving rise to the claim, or $100 if you did not pay us.

You agree to defend, indemnify, and hold QWYK iSoft harmless from claims, losses, liabilities, damages, costs, and expenses arising from your business, your profile, your content, your review practices, your third-party integrations, your violation of these terms, or your violation of law or third-party rights.

11. Governing Law and Disputes

These terms are governed by Texas law, without regard to conflict-of-law rules. Disputes will be resolved by binding arbitration in Austin, Texas, unless a claim qualifies for small claims court or we seek injunctive relief for misuse, security, confidentiality, or intellectual property issues. You waive the right to a jury trial and class action to the fullest extent permitted by law.

12. Changes

We may update these terms as trustSYSTEM evolves. If changes are material, we will provide notice by posting the updated terms, emailing you, or notifying you through the service. Continued use after the effective date means you accept the updated terms.
